Terms and Conditions: 30 Day Winterm Evaluation Offer
 

This Agreement sets forth the terms and conditions of your use of Wyse Winterm unit (Product) for a 30-day evaluation.
 
  1. "No risk evaluation" of your Winterm unit begins 30 days after you receive your Winterm from Wyse Technology Inc.
  2. The Var is fully responsible for shipping costs to and from the locations they designate back to our demo pool depot.
  3. To receive the Winterm unit, all you need to be is an authorized Canadian VAR with an existing WPVR# in order to complete the registration request form. 
  4. During the testing period, you are liable for any damage to the Winterm unit.
  5. The provisions of the software license, which is included in the documentation provided with the Winterm evaluation unit, apply to your usage of the product.
  6. To ensure your account is not closed or suspended, ensure that the evaluation unit is returned in the accompanying packaging using the accompanying RMA documentation (enclosed with evaluation unit) within 30-day evaluation period. If the unit is not returned within 45 days of the initial shipment of the product, you're account will be suspended. In the event that you require additional time to evaluate the equipment, please email your regional Wyse Sales representative of the need for an exception and reasons.
  7. The units are free for 30 days and are not meant for purchase. If not returned in the stated time frame they must be paid for at full list price and possible suspension or termination of use of the demo pool could result.
  8. Limitation of Liability: NEITHER PARTY SHALL BE LIABLE TO THE OTHER FOR ANY INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF THIS AGREEMENT OR THE RELATIONSHIP BETWEEN WYSE AND EVALUATOR, INCLUDING WITHOUT LIMITATION, LOSS OF PROFIT.

The laws of the State of California govern this Agreement.
